A RESOLUTION REAFFIRMING <br /> NO VIOLATIONS WITHIN THE 0-75' <br /> LAKESHORE PROTECTED AREA AT THE PROPERTY <br /> LEGALLY DESCRIBED AS LOT 2, BLOCK 1, PARWOOD, <br /> HENNEPIN COUNTY, MINNESOTA <br /> WHEREAS, Gabriel Jabbour (hereinafter "Owner") is the <br /> owner of the property located at 985 Tonkawa Road within the City <br /> of Orono (hereinafter "City") and legally described as Lot 2, <br /> Block 1, Parwood, Hennepin County, Minnesota (hereinafter <br /> "property"); and <br /> WHEREAS, the owner has requested a formal resolution of <br /> the City reaffirming that all previously recorded violations <br /> within the 0-75' lakeshore protected area have been removed and <br /> satisfactorily resolved. <br /> NOW, THEREFORE BE IT RESOLVED, by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. On December 14, 1987, the former owner, Richard Mast, <br /> had contracted with a landscape company to remove <br /> approximately 8 trees with trunks in excess of 6" in <br /> diameter. <br /> 2. Orono's Zoning Code Section 10.22, Subdivision 3 Tree <br /> Removal Regulations - requires a permit from the City for <br /> the removal of all live trees within 75' of the shoreline <br /> with a diameter of 6" or more. <br /> 3. Neither the former owner, Mr. Richard Mast, nor the <br /> landscape contractor obtained the necessary permits for the <br /> removal of such trees. Dale A. Gustafson, a landscape <br /> architect, confirmed that at least 4 of the trees were dead <br /> and the remaining were potential safety hazards. <br /> 4. On July 20, 1988, the current owner, in a letter dated <br /> July 20, 1988, agreed to a landscape improvement plan within <br /> the 0-75' area involving: <br /> a. immediate erosion control steps for disturbed area; <br /> b. replanting of 4 trees within the lakeshore <br /> protected area. <br /> Page 1 of 2 <br />
