o,�,. <br /> 0 0 <br /> CITY of ORONO <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> S80 NO. 5 9 8 <br /> A RESOLUTION REVISING <br /> RESOLUTION NO. 5857 <br /> FILE NO. 09-3414 <br /> AND <br /> RESOLUTION NO. 2324 <br /> FILE NO. 1227 <br /> WHEREAS, Patrick Middleton and Kathleen Middleton, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 720 Tonkawa Road within <br /> the City of Orono (hereinafter the "City") and legally described as follows: <br /> Attached as Exhibit A, Hennepin County, Minnesota (hereinafter the "property"); <br /> and <br /> WHEREAS, in order to construct a larger entry porch the applicants have made <br /> application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78- <br /> 1403 to allow 18.01 percent structural coverage when 17.85 percent was approved by Resolution <br /> No. 5857, 18.64 percent previously existed and 15 percent is allowed; and <br /> WHEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow an additional 317 square <br /> feet of hardcover in the 75 to 250 foot zone to allow for a sidewalk and other items not included <br /> in Resolution No. 2324. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. The Planning Commission reviewed this application at a public hearing held on <br /> January 19, 2010, and by a vote of 6 - 0 recommended approval of the revisions <br /> to the variances based on the following findings: <br /> a. Because of an error in calculating existing structural coverage, the original <br /> application appeared to be a request for additional structural coverage when in <br /> Pagel of 3 <br />
