AGENDA ITEM <br />Item No.: 12 <br />Date: December 11, 2017 <br />Item Description: #17-3980, Shawn Wischmeier, 540 Big Island — Variance <br />After -The -Fact — Resolution <br />Presenter: Melanie Curtis Agenda Planning Department <br />Planner Section: Report <br />1. Purpose. This application is regarding an after -the -fact variance to permit a detached <br />shed constructed less than 10 feet from the principal structure. <br />2. MN§15.99 Application Deadline. The application was received on September 20, <br />2017; it was considered as complete on November 1St. Therefore the 60 -Day review <br />period expires on December 31 st, 2017. <br />3. Background. A permit for the new home under construction on the property was issued <br />in May, 2017. However, due to the remoteness of the Big Island property and winter <br />weather approaching, the applicant began construction on the 300 square foot shed prior <br />to the issuance of a building permit this fall. The location of the shed is 6.7 feet from the <br />principal structure where a 10 -foot setback is required. Construction on the shed has <br />been stopped. <br />4. Planning Commission Comment. On November 20th, the Planning Commission held a <br />public hearing and reviewed the application. Following the public hearing the Commission <br />voted 5 to 0 on a motion to approve the after -the -fact variance subject to issuance of a <br />building permit conditioned on compliance with Building and Fire Codes. The <br />Commission noted that the 10 foot setback requirement is mainly to address concerns with <br />massing, and massing is not a concern due to the island location of the lot, and the setback <br />from the lake. <br />5. Public Comment. No comments from the public were received regarding this application. <br />6. Staff Recommendation.
