Purpose. This application is regarding a conditional use permit (CUP) for a permanent <br />dock installation. <br />2. MN§15.99 Application Deadline. The application was received and was considered to <br />be complete on October 17, 2017. The 60 -Day review period expires on December 16, <br />2017. <br />3. Background. The applicant proposes to replace their existing seasonal dock on their <br />property with a new permanent dock. Because of the permanent nature of the dock <br />structure within the floodway, a conditional use permit (CUP) is required. The Lake <br />Minnetonka Conservation District (LMCD) regulates docks on the Lake. A LMCD <br />permit was issued on November 20th; the installation will be done over the winter. <br />4. Planning Commission Comment. On November 20th, the Planning Commission held a <br />public hearing and reviewed the application. Following the public hearing the Commission <br />voted 6 to 0 in favor of a motion to approve with the following conditions: <br />a. The dock shall be allowed as long as it continues to be permitted by the LMCD and <br />DNR and is in conformity with the rules and regulations of those agencies; and <br />b. The dock is not to be used for commercial purposes or rented. <br />5. Public Comment. No comments have been received on this application. <br />6. Staff Recommendation. Staff recommends approval of the CUP to allow the permanent <br />dock to be installed. <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the approval resolution. <br />Exhibits <br />Exhibit A.
