MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, October 23, 2017 <br />7:00 o'clock p.m. <br />PLANNING DEPARTMENT REPORT <br />12. #17-3968 SHARRATT DESIGN AND COMPANY ON BEHALF OF FREDERICK AND <br />PATRICIA JOHNSON, 1565 ORCHARD BEACH PLACE (PID 07-117-23-0026) — RESOLUTION <br />NO. 6801 & RESOLUTION NO. 6802 <br />Curtis noted the City Council directed Staff at its last meeting to draft a resolution denying the request for <br />a rear yard setback variance and to draft a resolution approving the request for an average lakeshore <br />setback variance, lot area and lot width variances. <br />Tonight the applicant is asking the City Council to reconsider the rear yard setback variance. The <br />applicant has provided revised house and site plans showing an example of the home footprint. The <br />designed home is within the approved building footprint and intended to conform to all applicable zoning <br />code requirements, including height. The applicant has also provided a revised site plan and house plan <br />to illustrate their amended rear yard setback request to permit a 20 -foot rear yard setback, which would <br />allow for additional width to accommodate a 2 -car garage. <br />Michael Sharratt, Sharratt Design, stated they listened to the concerns expressed by the City Council at <br />the last meeting and they have revised their plans to address the rear yard setback. Sharratt stated they are <br />not suggesting this is a resolved concept and that it may need more scrutiny but that it was the best they <br />could do within the last few days. <br />Sharratt stated their other plan reacts to the requirement for a two -car garage. If a variance is not <br />requested and there is just a one -car garage, there is only one place to obtain a two -car width and that is <br />toward the rear property line. Sharratt stated they increased the setback request to ten feet and decreased <br />the width of the garage. Sharratt noted the minimum is typically 20 or 22 feet. Sharratt stated if that is <br />not possible, then the variance for the one -car garage has to be applied for. <br />Sharratt noted there is only 8.3 feet on the east property line and that they have shrunk the building <br />footprint to 416 square feet. The upper levels are cantilevered over that are. As a result, Plan A shows <br />hardcover at 10.3 percent where 25 percent is allowed, and it meets the right, lake side setback. Plan B <br />has 15 percent hardcover or 50 percent of what is allowed for structural coverage <br />Crosby asked if they are meeting the rear setback. <br />Walsh stated the plans are showing what could be built with a 20 -foot rear yard setback instead of 30 feet. <br />Mayor Walsh asked if there is any public comment regarding this application. <br />Shawn McDermott, 1530 Orchard Beach Place, requested the City Council apply the City ordinances as <br />they stand right now. McDermott noted the applicant is looking for four variances on this property and <br />that the neighbors are looking at the negative impact this project would have on their property values. <br />McDermott stated he would appeal to the City Council to consider the common benefit of the City and <br />the people who live in the neighborhood and not the benefit of one landowner. <br />There were no further public comments. <br />Page 6 of 11 <br />
