AGENDA ITEM <br />Item No.: 13 <br />Date: November 13, 2017 <br />Item Description: #17-3974, SML Electric o/b/o Bridgewater Bank, 2445 <br />Shadywood Road, Variance — Resolution <br />Presenter: Jeremy Barnhart, Community Agenda Consent Agenda <br />Development Director Section: <br />1. Purpose. This action item is to consider a variance that would allow the expansion of a non- <br />conforming sign within the front yard setback. <br />2. Minnesota Statutes 15.99 Deadline. This application must be acted on by November 24, 2017 <br />3. Background/ Summary. Bridgewater Bank recently completed an overhaul of the existing bank <br />building, and now desire to replace the existing sign and make it more consistent with the <br />construction style and materials of the bank building. The sign is non -conforming as it is within the <br />10 foot front yard setback. The applicant could replace the sign in kind, but desire to add to the base <br />of the sign with stone accent. The sign increases in width (at the base) and in thickness, requiring a <br />variance. <br />Original plans proposed the sign to be internally lit, but at the Planning Commission meeting, the <br />applicant suggested ground mounted flood lights lighting the sign from below. Plans have been <br />revised to show the flood lighting to be mounted to the sign itself, addressing staff concerns that the <br />light source might be visible for passers-by. <br />4. Planning Commission comment. The Planning Commission, after the public hearing, had no <br />concerns with the sign as proposed. Their motion to support did include a preference for the sign to be <br />back -lit. There is no prohibition to exterior light a sign, though the light source may not cause heat or <br />glare. Mounting the light source to the sign will block its view from travelers on Shadywood Road. <br />5. Public Comment. No comments in support or opposition of the variance have been received. <br />6. Staff Recommendation. Staff recommends adoption of the resolution as drafted. <br />COUNCIL ACTION REQUESTED <br />Motion to adopt resolution approving the variance to allow for the expansion of the non -conforming sign. <br />Exhibits <br />Exhibit A.
