CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION DENYING <br />PRELIMINARY PLAT <br />INCLDUING A VARIANCE FROM CITY CODE SECTION 78-330 <br />AT 4035 DAHL ROAD <br />FILE NO. 17-3963 <br />WHEREAS, JHG Properties LLC, a Minnesota Limited Liability Company, <br />(hereinafter the "Applicant") is the owner of 4035 Dahl Road within the City of Orono (hereinafter <br />the "City"), identified as Hennepin County PID 07-117-23-14-0003, and legally described as: <br />That part of Section 7, Township 117, Range 23, described as follows: <br />Commencing on the North line of the Southeast Quarter of the Northeast Quarter <br />of said Section at a point distant 275 feet West from the Northeast corner thereof; <br />thence South 150 feet; thence West parallel with the North line of said Section to <br />the center line of the road; thence Northwesterly along the center line of said road <br />to the North line of the Southeast Quarter of the Northeast Quarter; thence East to <br />the beginning, Hennepin County, Minnesota, (hereinafter the "Property"); and <br />WHEREAS, the Applicant has applied to the City of Orono for approval of a <br />variance from City Code Section 78-330 in order to permit a subdivision of the 1.8 acre property <br />within the LR -11B, One Family Lakeshore Residential Zone requiring a minimum of 1.0 acre and <br />140 feet of width (hereinafter the "Proposed Development") and <br />WHEREAS, the Planning Commission held a public hearing on August 16, 2017 <br />and reviewed the application at this same meeting and <br />WHEREAS, on September 11, 2017, the City Council reviewed the Proposed <br />Development and the recommendations of the Planning Commission and City staff; and <br />WHEREAS, on September 11, 2017, the City Council directed preparation of <br />findings for denial of the variance; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby denies the Proposed Development as described above based on one or more of the <br />following findings of fact concerning the Property: <br />FINDINGS <br />This application was reviewed as Zoning File 17-3963. <br />
