CITY OF ORONO 1 ORONO PUBLIC SCHOOLS <br />LEASE AGREEMENT <br />THIS AGREEMENT, made by and between the CITY OF ORONO and ORONO <br />PUBLIC SCHOOLS, INDEPENDENT SCHOOL DISTRICT 278, both political <br />subdivisions of the State of Minnesota, hereinafter referred to as the "City" and the <br />"School District," respectively. For purposes of this Agreement, the address of the City <br />is 2750 Kelley Parkway, Orono, MN 55356, and the address of the School District is 685 <br />Old Crystal Bay Road North, Orono, Minnesota 55356. <br />WITNESSETH <br />WHEREAS, the Hennepin County Board of Commissioners in Resolution <br />Number 13-0134 and Resolution Number 05-564 authorized the purchase of Election <br />Equipment and Assisted Voting Technology equipment for a countywide digital scan <br />voting system, election hardware and services, and <br />WHEREAS, the Hennepin County, a political subdivision of the State of <br />Minnesota ("Hennepin County"), and the City of Orono are parties to an agreement <br />numbered A-131257 relating to the lease of Election Equipment and AVT equipment (as <br />defined herein); and <br />WHEREAS, the City desires to sublease Election Equipment and AVT <br />Equipment to the School District for use in all School District elections. <br />WHEREAS, the City also desires to lease voting booths to the School District for <br />use in all School District elections. <br />NOW THEREFORE, in consideration of the mutual undertakings and <br />agreements hereinafter set forth, the City and the School District agree as follows: <br />Section 1 <br />SCOPE OF AGREEMENT <br />1.1 The City hereby subleases to the School District at the cost identified below and <br />subject to the terms and conditions of this Agreement, and the School District <br />hereby agrees to sublease from the City election equipment identified as: two (2) <br />DS200 Digital Scan Precinct Count Units (including four (4) 4 GB Jump Drives), <br />and two (2) DS200 Plastic Ballot Boxes (the "Election Equipment") for polling <br />places contained within the School District. <br />1.2 The City hereby subleases to the School District subject to the terms and <br />conditions of this Agreement, and the School District hereby agrees to sublease <br />from the City Assisted Voting Technology Equipment identified as: one (1) <br />AutoMARK Voter Assist Terminals, two (2) flashcards and one (1) ES&S <br />171938v3 Page 1 of 8 <br />
