This letter is in response to your email of July <br />27, 2017, concerning the May 1, 2017, letter the City received from the attorney for Jay <br />and Tera White, David T. Johnson. Mr. Johnson outlines concerns of the Whites related <br />to access, alleged encroachments, drainage/proximity, and utilities. I would like to <br />address each of those concerns. <br />I note for the record that Mr. Johnson's suggestion that Curt Fretham had not <br />been in touch with the Whites is inaccurate. Mr. Fretham met with Mr. White in person <br />on December 26, 2016, and discussed the Whites' desire to purchase from Lake West, at <br />well below market rate, a strip of land to alleviate the encroachment of their deck, <br />driveway, and utilities. Mr. Fretham remains willing to discuss these issues with the <br />Whites, while observing that the Whites are the encroaching parties, and Lake West, in <br />the absence of some other agreement, has the right to demand that the Whites remove <br />these encroachments. Mr. Fretham does not intend to take that action, but would be <br />within his rights to do so. <br />Neither the Whites nor their attorney appeared at the sketch plan review meeting <br />before the Council on May 8, 2017. The Whites have taken no action to enforce their <br />
