Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the variance(s), if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions in order to mitigate the <br />impacts created by the granting of the requested variance(s)? <br />4. Are there any other issues or concerns with this application? <br />Planning Commission Action Requested <br />The home on 940 North Arm Drive was constructed in accordance with the minimum Building Code <br />standards. The City does not (and may not) have a prohibition on any of the different home or <br />construction types which meet the Building Code. Staff suggests that the City Council may want to <br />explore the regulations which govern construction types or minimum construction standards (size, <br />width) specifically if the placement of mobile homes on properties within the City is a concern. <br />The Planning Commission should consider the following: <br />1. Approval of the lot area variance in order to create a new substandard (0.67 acre) buildable <br />lot; and approval of the Class III subdivision to create a total of two buildable lots where one <br />lot currently exists (including one new substandard lot). <br />If the Planning Commission finds variance approval appropriate, the applicant should be <br />directed regarding the waiver of the conservation design requirements. <br />INN <br />2.
