Council Exhibit C <br />17-3948 <br />AGENDA ITEM <br />Item No.: 10 Date: August 14, 2017 <br />Item Description: #17-3948, Apex Holdings, LLC, 2635 Kelley Parkway, CUP Senior <br />Housing Project, Comprehensive Plan Amendment, Rezoning and preliminary Master <br />Plan, Final Plat <br />Presenter: Jeremy Barnhart, Community Agenda Planning Department <br />Development Director Section: Report <br />1. Purpose. The purpose of this item is to consider several actions that would permit the construction of <br />Orono Senior Housing at 2635 Kelley Parkway. <br />2. 15.99 Deadline. The timeline has been extended. A decision must be made by October 27, 2017. <br />3. Background/ Summary. The property owner of 2635 Kelley Parkway seeks approval for a 70 unit, 2 <br />story residential structure that will include 24 units of senior housing, 24 units of assisted living, and 22 <br />units of memory care. Regulatory approval for the city will include rezoning to RPUD, approval of a <br />Comprehensive Plan Amendment from Office to High Density Residential, platting of the existing outlot, <br />and a Conditional Use Permit and master plan. The Planning Commission report, attached as Exhibit D <br />includes further detail on the application as well as staff's analysis. <br />Just prior to the Planning Commission meeting, the County identified a need to expand the existing <br />stormwater pond into the subject parcel, to support the Wayzata Blvd reconstruction. The applicant and <br />the County met to address this issue, and the final result will be reflected in the final Master plan, along <br />with any changes suggested by the City Council. <br />The biggest issue based on public comment is the height of the building. The applicants proposed a 2 <br />story building with a defined height of 31-32 feet, 1-2 feet higher that allowed by the RPUD ordinance. <br />The increased height is due in part of an effort to retain the residential gable and hipped roof as required <br />by the RPUD ordinance. A flat roofed, two story building would be shorter but inconsistent with the <br />residential character envisioned. The Commission discussed the height of the building, its impact on <br />Kelley Parkway and asked that an exhibit be created that showed the building in relation to Kelley <br />Parkway and the Stonebay Lofts building beyond. That drawing is attached as Exhibit B. The finished <br />floor of the proposed building will be about 4-7 feet higher than Kelley Parkway; the drawing does not <br />reflect this profile, staff has requested a revised drawing. Regardless, the highest point of the building <br />will be 11 feet shorter than the condominium building across the street and setback 15 feet further. <br />4. Planning Commission vote and comment. The Planning Commission voted 7-0 to support the <br />requested actions. The Planning Commission commented on parking, suggesting perhaps that bump out <br />spaces could be added along Kelley Parkway. The Commission suggested a second access, to which the <br />applicant did not object. The Commission was wary of waiving the 10% private recreational space required <br />of RPUD, and suggested the patios and pavilion be counted as private recreational space, bringing the total <br />closer to 10%. The open space exhibit shows 4 areas, totaling 11 percent of the total site area. These areas <br />proposed are more geared toward quiet reflection and people watching, rather than active recreation. The <br />Commission questioned the trail easement; staff replied either the developer will build a trail on their land <br />as per the original development agreement, or the County will build a trail in their right of way, and the <br />developer will pay their trail costs towards the city's potion. <br />5. Public Comment. During the public hearing, three people spoke, voicing concerns with building <br />height, only one access, whether or not the building should front Wayzata Blvd instead of Kelley Parkway, <br />and parking. An email noting concerns regarding height was also distributed.
