AGENDA ITEM <br />Item No.: 10 Date: August 28, 2017 <br />Item Description: Crystal Bay Road, Right of Way Adjustment <br />Presenter: Jeremy Barnhart, Community Agenda Consent Agenda <br />Development Director Section: <br />1. Purpose. The purpose of this action item is to initiate discussion related to an adjustment of right of <br />way and Crystal Bay Road. <br />2. Background. At its meeting on July 17, the Council tabled action on Catherine Sweet's street <br />vacation to review relocating the right of way. It was noted during the meeting that Old Crystal Bay Road <br />as improved does not follow the dedicated right of way, and the majority of that 1,700 foot long stretch <br />does not have any corresponding platted right of way. <br />The following options are based on Hennepin County published data. Formal action should start with a <br />survey of the area. Surveys are estimated to cost $5-$12,000. To "relocate the right of way", one of two <br />actions would be required: <br />1. Acquire through purchase or condemnation additional right of way from 24-28 individual lots <br />along Crystal Bay Road. The variable is the location of the road in relation to not yet surveyed lots. <br />2. Relocate Old Crystal Bay Road as it encroaches into the city owned parcels lakeward of parcels A- <br />D on the attached map. This would involve removing the portion of Crystal bay Road and shifting it <br />south, towards the 4 houses in the area. <br />3. Funding. No funds have been budgeted for relocation of the road, acquisition of right of way, or <br />preliminary ground work (surveys, title work). <br />4. Staff Recommendation. Recognizing the desire to `clean up' road irregularities, staff does not <br />recommend action at this time. The cost to benefit ratio does not support action. If the council feels <br />strongly on the need to correct these right of way issues, staff can identify additional areas needing <br />attention, and come back with recommendations for the Capital Improvement Plan (CIP). <br />COUNCIL ACTION REQUESTED <br />Motion to direct staff that no further action is necessary at this time. <br />Exhibits <br />Exhibit A.
