SUPPLEMENTARY CONDITIONS <br /> ' OF THE CONTRACT <br /> ' 1. SCOPE <br /> ' The articles contained in the Supplementary General Conditions of the Contract may <br /> amend, modify, supersede, void or supplement the Articles of the General <br /> Conditions of AIA Document, A201, and when applicable, and if used, AIA <br /> Document A201/SC (latest edition) and shall take precedence over the provisions of <br /> the General Conditions. Where any part of an article of General Conditions is not so <br /> amended, modified, superseded or voided by a provision of the Supplementary <br /> ' General Condition, such part shall remain in effect. <br /> ' 2. CONTRACT DOCUMENTS <br /> Article I of the General Conditions is amended as follows: <br /> The Contract Documents include bidding documents including the Instruction to <br /> Bidders, samples of forms, the Contractor's Bid and any addenda thereto. <br /> ' 3. ARBITRATION <br /> ' Arbitration referred to in Article 2.2.12 and described by Article 7.9 of the General <br /> Conditions does not apply to Contracts within the State of Minnesota. The following <br /> paragraphs apply: <br /> ' In case any question, dispute, or controversy arises between Temple Israel and the <br /> Contractor out of any provision of the Contract Documents, such dispute of <br /> controversy-shall be referred to a neutral individual or organization designated by <br /> the Commissioner of Administration such as the American Arbitration Association or <br /> the Office of Administrative Hearings, whose decision shall be final and binding upon <br /> ' all parties. All costs of arbitration shall be born by the party demanding arbitration <br /> subject to any award of costs by the arbitration panel. In case any question, dispute <br /> of controversy arises between the contractor and other independent specialists, <br /> ' consultants, or contractors separately employed by Temple Israel, such dispute or <br /> controversy shall be referred to the Commissioner of Administration whose decision <br /> shall be final and binding. <br /> ' The venue for arbitration is herein agreed to be Hennepin County, State of <br /> Minnesota, unless otherwise specifically agreed. <br /> ' The Contractor shall carry on the work and maintain the progress schedule during <br /> any arbitration proceeding, unless otherwise agreed by the Contractor and the <br /> Owner in writing. <br /> 9 <br />
