the home 4101 is set back +/- 16 feet behind the 75 foot set back resulting in an inadvertent
hardship for sight line set backs on this lot.
2. Planning Council did not recommend any increase to the sq footage of the decking and the new
proposed deck is the same size. They recommended a "reconfigu ration". See the actual
meeting minutes on what was discussed>
a. Meeting Minutes copied from applicatioli: Thiesse indicated he is in agreement with
Commissioner Schoenzeit. Thiesse stated in his view the deck is not very practical since
it is not even four feet. Thiesse noted they are placing the whole house out of the 75 -
foot area but placing the deck within the 0-75 foot zone. Olson commented the deck is
also oddly shaped. Peterson concurred the deck is awkward, and if they are not going to
be able to have the steps on the west side due to the encroachment, they maybe could
look at redesigning it. Peterson noted it is approximately15 feet up and that they would
like to have stairs going down. Thiesse stated he hates to meet the intent of the
ordinance simply to meet the intent of the ordinance and then not be able to use what
they have. Schwingler commented it is a great improvement to the property and
decreases the hardcover. Schwinger stated in his view there is a practical difficulty.
Schoenzeit stated by giving them some credit for keeping the five feet, they could
maybe have more on the lakeside. Schoenzeit stated the way to go would be to have a
normal shaped deck that is six or eight feet lakeward of the end of the house but not
going past the 5 -foot line. Thiesse noted eight feet is not very much but that they would
be able to have a round table with some chairs on it. Thiesse stated he would prefer to
have a usable deck. Schoenzeit stated he would prefer not to have anything within the
5 -foot setback and that they could redesign it to come off the end of the house.
3. The new construction of the home is in full height compliance and the home is 2 level and
basement to be clear. I have made many accommodations to reduce the height as much as the
architect said is possible due to elevations with connecting to the garage. We have also reduced
the pitch and made cut outs in the corner on south east and west side 5 feet which involves
significantly more expenses although this was done in the design for me to help provide greater
line of sight of the home to the neighbors especially to the east 4101 Highwood to help all in
the spirt to be neighborly even though we are in compliance. We also updated the design to
move the footprint of home further to the west so there is no side variance on the east which
was out of a request of 4101 neighbor.
4. 1 have provided nothing but consistent communication and stopped over to the site many times
and responded with many compromises and efforts as I stated to work Together on the project
not build walls with neighbors that is part of my foundation in all this project. My wife and I
even dropped of a card and wine stating how we appreciate in advance the construction
disruptions and looking forward to being neighbors. The specific comment that "I have not
Heard from HIM" is not correct as I have been in constant communication. see screen shot of
my response:
