This application is regarding variances to redevelop the substandard property. <br />2. MN§15.99 Application Deadline. The application was received on February 22, 2017; it was <br />considered as complete on March 6. Therefore the 60 -Day review period expires on May 5, 2017. <br />Background. The applicants recently purchased the newly constructed home at 4009 North <br />Shore Drive; they subsequently acquired the subject property at 4005 North Shore Drive and wish <br />to construct a new single family residence and in -ground swimming pool. Due to the shape, size, <br />and location of the property, the applicants are requesting side street setback and average <br />lakeshore setback variances for the home and pool. Additionally, the property does not conform <br />to the LR- I B minimum size and width requirements; lot area and lot width variances are required. <br />4. Planning Commission Comment. On March 20, the Planning Commission held a public hearing <br />and reviewed the application. Following the public hearing the Conunission voted 5 to 0 in favor <br />of a motion to approve the variances subject to the following conditions: <br />a) The driveway must be revised to comply with City codes and Hennepin County permits; <br />b) Submittal of revised hardcover calculations resulting from the above required driveway <br />changes; <br />c) Clarification about and revision of the proposed privacy fence; and <br />d) Submittal of retaining wall engineering with the building permit. <br />Public Comment. Comments from the public were received and included in the Planning <br />Commission packet. Additional comments and testimony was provided during the meeting. Please <br />refer to the attached Planning Commission minutes for further detail. No comments have been <br />received after the meeting. <br />6. Updates. The applicants have worked with Hennepin County on the driveway access permit and <br />have provided a revised plan meeting Hennepin County's and the City Engineer's approval. <br />Further, the applicants have reached out to some of the neighbors and believe they have reached <br />an understanding and/or compromise addressing the neighbor's concerns. <br />The revised plan uses the existing curb cut onto North Shore Drive. This results in a narrow <br />driveway corridor running along the east lot line. The applicants are proposing to construct a <br />privacy fence 10 feet from the property line on the interior side of the driveway with plantings on <br />the inside of the fence. The revised plan reflects an increase in the hardcover proposed from <br />21.6% to 24.8%, this increase is conforming. <br />7. Staff Recommendation. Staff recommends approval with the condition that the applicant <br />provide an off-site staging and parking plan for contractors working on the site during the <br />demolition of the existing home and the construction of the new home.
