AGENDA ITEM <br />Item No.: 9 <br />Date: June 11, 2018 <br />Item Description: LAI 8-38, James and Mary Jundt, 1400 Brackets Point Road, <br />Final Plat and Development Agreement Approval — Resolution <br />Presenter: Jeremy Barnhart, Community Agenda Consent Agenda <br />Development Director Section: <br />1. Purpose. This item is to consider the Final Plat of Southways, a four lot subdivision of 1400 <br />Bracketts Point. <br />2. 15.99 Deadline. Application was received on April 03, 2018. The application was considered <br />complete on April 24t''. Action must be taken by June 23, 2018. <br />3. Background/ Summary. The City Council adopted resolution 6835, on February 26, 2018, <br />approving the preliminary plat for Southways, a 5 lot single family residential subdivision. Also on that <br />date resolution 6836 approved the street vacation of a portion of Bracketts Point Road. <br />The proposed final plat is consistent with the approved Preliminary Plat, with the exception being the <br />preliminary plat suggested five lots, and the final plat proposes four. All lots meet the requirements of the <br />zoning ordinance in terms of lot width and size. The proposed use of the property, single family <br />residential at density of .5 units per acre is consistent with the Comprehensive Plan. <br />A Development Agreement has been prepared by the City Attorney, and has been signed by the applicant, <br />in anticipation of Council Approval. All costs associated with the development, including street/ utility <br />abandonment and construction, storm water management, erosion control, etc., are the responsibility of <br />the developer. <br />4. Staff Recommendation. Staff recommends approval of the Final Plat and authorization of the <br />Developers Agreement as proposed. <br />COUNCIL ACTION REQUESTED <br />Staff Recommendation: Motion to amend or adopt the attached resolution.
