MEMORANDUM OF UNDERSTANDING <br />Between <br />o The City of Orono <br />e <br />And <br />International Union of Operating Engineers, Local No. 49 <br />March 30, 2018 <br />RE: Park and Golf Course Supervisor Scheduling Flexibility <br />The purpose of is memorandum is to outline an exception to the employee scheduling and <br />overtime rules as defined and subject to the bargaining agreement between the City of Orono and the <br />International Union of Operating Engineers Local 49 for the Parks and Golf Course Supervisor Position. <br />Relevant bargaining agreement articles: <br />Articles 3.1 and 12.1 defines overtime as: Overtime is defined as all hours in excess of forty (40) hours per <br />week Monday — Friday; all hours worked on Saturday and Sunday and all hours worked on a non -weekend <br />holiday. <br />Article 11.1 defines the normal workday and the employer's authority to set work schedules: The sole <br />authority in work schedules is the Employer. The normal regular work day shall be eight (8) hours. The <br />normal work week shall be forty (40) hours Monday through Friday. Public Works normal scheduled work <br />hours are from 7:00 a.m. to 3: 30 pm. <br />The nature of the Parks and Golf Course Supervisor position and duties requires additional <br />schedule flexibility. To that end both the City and Local 49 agree that the Parks and Golf Course <br />Supervisor shall be allowed to work a flexible work schedule with overtime defined as any hours in <br />excess of forty (40) hours per week, Monday through Sunday.
