AGENDA ITEM <br />Item No.: 11 <br />Date: February 26, 2018 <br />Item Description: #18-3998 — James and Mary Jundt, 1400 Brackets Point Road, <br />Preliminary Plat, Street Vacation <br />Presenter: Jeremy Barnhart, Community Agenda Planning Department <br />Development Director Section: Report <br />1. Purpose. This item is to consider a preliminary plat and right of way/ easement vacation associated <br />with a proposed 5 lot subdivision at 1400 Bracketts Point Road. <br />2. 15.99 Deadline. Action must be taken by April 13, 2018. <br />3. Background/ Summary. This proposal was reviewed by the City Council as a sketch plan in <br />November, 2017. The proposed preliminary plat is consistent with that sketch plan. All lots meet the <br />requirements of the zoning ordinance in terms of lot width and size. <br />Lot <br />Area (acres) <br />Width at lake (feet) <br />Lot 1, B1 <br />2.41 <br />335 <br />Lot 2, BI <br />2.1 <br />349 <br />Lot 3, B1 <br />2.35 <br />363 <br />Lot 1, B2 (Existing House) <br />3.36 <br />415 <br />Lot 2, B2 <br />2.06 <br />202 <br />The proposed use of the property, single family residential at density of .5 units per acre is consistent with <br />the Comprehensive Plan. <br />The main feature of this project is the relocation of a portion of public Brackets Point Road from the <br />western edge of the peninsula to the center of the peninsula. This relocation will require vacation of the <br />existing right of way, and the sanitary sewer easement along this road. The Planning Commission staff <br />report, attached as Exhibit C provides additional detail on the proposal. <br />4. Planning Commission Vote and Comment. The Planning Commission voted 5-0 on two separate <br />motions, one to approve the right of way and the easement vacation and a second to approve the <br />preliminary plat as recommended in the staff report. Commissioners specifically noted that the trees <br />replacing those removed should be planted in more of a natural pattern, versus equally spaced along the <br />relocated road. <br />Public Comment. A neighboring property owner to the south, Bruce Paddock, commented during the <br />public hearing He felt that the lot housing the former Pillsbury house should be larger, possibly <br />incorporating the adjacent lot, lot 2, Block 2. The lot housing the Pillsbury House is the largest within the <br />subdivision and exceeds the minimum lot size outlined by the city code. He also commented that the <br />private portion of Bracketts Point Rd should be converted to a public road. Since the Planning <br />Commission meeting, the property owner has contacted city hall with a request to convert the road from <br />private to public. The road is currently proposed simply as a relocation of an existing public road, and is <br />proposed to remain public. The proposed configuration and cul de sac improves the circulation in the <br />area, allowing for a more efficient turn around, pulls hard cover away from the lake, and create a more <br />logical route for access to the three lots to the south of the point. <br />5. Staff Recommendation. Staff recommends approval of the preliminary plat and vacation of the road <br />and easements, subject to the following conditions: <br />Prepared By: J.
