Driveway. <br />3. Association's Riahts in Common Roadway and Common <br />A. The Association shall have the right and duty to <br />manage, build, reconstruct, repair, maintain and improve the Common <br />Roadway (and to pay all taxes and assessments separately assessed <br />against the same); the. Common Driveway, .the Utility and Drainage <br />Easement and the Drainage Easement, but in each case only to the <br />extent not inconsistent with easement rights and restrictions granted <br />contemporaneously herewith in favor of the City of Orono. <br />B. The Association shall have an easement over and <br />upon the Common Roadway and Common Driveway for the installation <br />an <br />zAd maintenance of <br />•� y and all pipes, wires and other conduits of <br />matter of energy necessary or desirable to serve any Lot. <br />C. The Association shall have the right to dedicate or <br />' transfer all or any part of the Common Roadway and its easement <br />rights in the Common Driveway to the City of Orono or its successors, <br />; .nd shall have the right to dedicate or transfer easement and access <br />w; <br />'rights in all or any part of the Common Roadway and Common Driveway <br />to any governmental subdivision or public agency or utility. No <br />such'dedication or transfer under the provisions of this paragraph <br />shall, however, be effective unless assented to in writing by owners <br />� sof all of the Lots abutting the Compton Roadway or the Co=on Driveway,, <br />." (as the case may be) and unless approved and accepted by the City <br />of Orono or its successors. <br />4. Declarant's Rights in Common Roadway and Common Driveway <br />{ <br />A.
