270 nuisance, impound it, and assess the cost of removal to the sign owner or the sign <br />271 owner's agent. <br />272 <br />273 (3) Impoundment of signs on public property or within public right of way. The City <br />274 Administrator or their designee may, at any time and without notice, impound <br />275 signs that have been installed on public property, within the public right-of-way, <br />276 or within a public easement that are in violation of this division. The sign owner <br />277 or their agent may retrieve an impounded sign subject to the following rules: <br />278 <br />279 <br />a. Payment of an impoundment release fee. Any subsequent <br />280 <br />impoundment(s), within one calendar year, for a particular property or <br />281 <br />sign owner will require payment of double the initial impoundment release <br />282 <br />fee. <br />283 <br />284 <br />b. Any impounded sign may be retrieved from the impounded area within <br />285 <br />three (3) business days of the impoundment or the City Administrator or <br />286 <br />their designee may dispose of it. The impoundment area can be located by <br />287 <br />contacting City Hall. Any cost incurred by the City for disposal of an <br />288 <br />impounded sign may be assessed to the sign owner or the sign owner's <br />289 <br />agent. <br />290 <br />291 C. The City shall have no obligation to notify a property owner that it has <br />292 impounded a sign. <br />293 <br />294 d. The City shall not be held liable for any damage to an impounded sign. <br />295 <br />296 Sec. 78-1475. - Exempt Signs. <br />297 <br />298 All signs shall require an approved sign permit prior to placement except for the signs <br />299 specifically noted in this Section. Exempted signs shall not reduce the permitted signage for a <br />300 property. These exemptions shall not relieve the owner of the sign from the responsibility of its <br />301 maintenance and its compliance with the provisions of this division or any other law or <br />302 ordinance regulation the same. <br />303 <br />304 (1) Government signs. All government signs, including but not limited to traffic <br />305 control and other regulatory purpose signs, street signs, identification signs, <br />306 informational signs, danger signs, and railroad crossing signs. <br />307 <br />308 (2) Non-commercial signs in an election year. Signs of any size containing non - <br />309 commercial speech may be posted in any number beginning 46 days before the <br />310 state primary in a state general election year until ten (10) days following the <br />311 general election and thirteen (13) weeks prior to any special election until ten (10) <br />312 days following the special election provided that the signs are in compliance with <br />313 Minnesota Statutes. <br />314 <br />Page 7 <br />
