AGENDA ITEM <br />Prepared By: mcc Reviewed By: J Barnhart Approved By: DJR <br />1.Purpose. This application is regarding proposed changes for Accessory Building and Structure <br />setbacks. The changes proposed are primarily overall organization of the regulations in the Code, <br />and some adjustments to the setbacks. <br />2.Background/ Summary. Currently there are many specific rules for accessory structures and <br />buildings based on their size; the zoning district, lakeshore lot versus non-lakeshore lot; and in <br />some cases, the size of the lot; and where on the property it is located. These regulations (and the <br />exceptions) have evolved over time, to the point where they have become difficult to understand <br />and require extensive ‘flowcharting’ to drill down to the applicable regulation. Most <br />homeowners are not experts on code regulation and may have difficulty understanding the <br />regulations on their own. Further, the terms structure and building, though defined differently, <br />are used interchangeably within the regulations. <br />The Planning Commission has been working on this amendment since June. Staff has prepared a <br />draft ordinance based feedback for consideration and discussion. The code has been reorganized <br />so that a user can find the majority of the information regarding principal building, accessory <br />buildings, and accessory structure setbacks within the specific zoning district sections. Additional <br />modifications were made in the Accessory Buildings and Structures, and Nonencroachment <br />sections. <br />Summary of Changes: <br />Correction and clarification between terms: “building” and “structure” (Reference: Draft <br />Ordinance Section 1). <br />Reorganization of all setback information into each zoning district section. (Reference: <br />Draft Ordinance Sections 2 through 9). <br />Clarification of the terms (Reference: throughout): <br />a.AS = Accessory Structure, anything which is built, constructed, erected, etc… <br />b.AB = Accessory Building (a structure with a roof) less than 1000 square feet <br />c. OAB = Oversized Accessory Building a structure with a roof exceeding 1000 <br />square feet <br />Revised required setbacks for accessory buildings versus accessory structures <br />(Reference: Draft Ordinance Sections 2 through 9). <br />Removal of one level of accessory building size-based setback tiers. Reduced to two <br />different setbacks from three (Reference: Draft Ordinance Sections 2 through 9). <br />Removal of the definition of “private recreational facilities” (Reference: Draft Ordinance <br />Section 1). <br />Language clean up in the nonencroachments section (Reference: Draft Ordinance Section <br />22). <br />Allowance for accessory buildings to follow the nonconforming lot width flexibility for <br />side setbacks, and expanded the flexibility to other zones… (Reference: Draft Ordinance <br />Sections 2 through 9). <br />Allowance for accessory buildings streetward of principal buildings, only in RR-1A & <br />RR-1B districts, with certain aesthetic conditions (Reference: Draft Ordinance Section <br />32). <br />Item No.: 15 Date: November 13, 2018 <br />Item Description: LA18-000057 - Text Amendment: Accessory Buildings & <br />Structures Setbacks - Ordinance & Summary Ordinance <br />Presenter: Melanie Curtis <br />Planner <br />Agenda <br />Section: <br />Planning Department <br />Report
