To consider a preliminary plat that creates one residential buildable lot and an access <br />outlot at 1645 Shadywood Road. <br /> <br />2. MN§15.99 Application Deadline. The application was received on February 20, 2019 and <br />considered to be complete on April 3rd, 2019. The 120-Day review period has been extended and <br />will expire on August 1, 2019. <br /> <br />3. Background. This property was the subject of a preliminary plat in 2013, but expired with no <br />final plat. This layout is consistent with that proposal. The proposal includes two lots in a front <br />lot/ back lot configuration. All lots and the access outlot meet the size and width requirements of <br />the Zoning Ordinance. <br /> <br />The project will include grading for the house site, and the removal of some trees within the <br />interior of the lot. The grading will be done as part of the building permit. <br /> <br />4. Planning Commission Vote and Comment. On March 18, the Planning Commission held a <br />public hearing. Following the public hearing, the Planning Commission voted 6-0 on a motion to <br />approve the project. <br /> <br />The members of the Commission noted that the project is consistent with the applicable zoning <br />ordinance. <br /> <br />5. Public Comment. Comments from one neighbor has been received, and is attached as Exhibit D. <br />The neighbor’s concerns focused on overdevelopment of the area, stormwater, and tree removal. <br />The grading plan shows the creation of defined swales along the access aisle that will channel <br />water to the right of way. Stormwater management is looked at very carefully on all building <br />projects. The lots meet or exceed the minimum lot areas, there is no way to prevent future <br />subdivision if it meets applicable standards, and the trees are not protected and may be removed. <br /> <br />6. Staff Recommendation. Staff recommends approval of the preliminary plat by adopting the <br />attached resolution. <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the approval resolution and adopt or amend. <br /> <br />Exhibits <br />A.
