FILE # LA19-000007 <br />18 March 2019 <br />Page 5 of 5 <br /> <br /> <br />Practical Difficulties Statement <br />Applicant has provided supporting documentation regarding the applicable Practical Difficulties <br />attached as Exhibit B, and should be asked for additional testimony regarding the application. <br /> <br />Practical Difficulties Analysis <br />Staff finds that due to the applicant’s choice to build a replacement home within the existing <br />footprint there are difficulties limiting the volume expansion within the existing setback from <br />the lake. The location of the neighboring homes creating the average lakeshore setback also <br />impacts the proposed volume increases. Also, the proposed 61.2 foot setback from the lake <br />affects the opportunities for improvements on the lake side of the home. <br /> <br />The relocation of the lakeside patio to the main level of the home results in the loss of the <br />“nonconforming” status of the existing patio setback and hardcover. The new patio request <br />may be reasonable, however staff suggests a reduction in the size so that the 75-foot zone <br />hardcover is not increased over existing. <br /> <br />Engineer Comments <br />The City’s Engineer has conducted a cursory review of the plans. Those comments are attached <br />as Exhibit G. A more thorough review will be done at the time of the building permit review. <br /> <br />Public Comments <br />To date, no public comments have been received. <br /> <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the variance(s), if granted, will not alter <br />the essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions in order to mitigate the <br />impacts created by the granting of the requested variance(s)? <br />4. Are there any other issues or concerns with this application? <br /> <br />Planning Staff Recommendation <br />Planning Staff recommends approval should the planning commission agree with and/or identify <br />practical difficulties supporting the variances.
