ti <br /> Operations -2 - <br /> Regulatory <br /> 2 - <br /> Regulatory(2014-03355-MMJ) <br /> a) The combined cover of invasive cattail,purple loosestrife,and reed canary <br /> grass shall not exceed 20%total cover at any time during the 2015-2017 <br /> short-term management period. <br /> b) By the end of the second year of management(end of 2016)and through the <br /> end of the short term management period(end of 2017),total vegetative cover <br /> shall be no less than 80%,not including open water areas. <br /> c) Just prior to the end of the short-term management period(end of 2017), <br /> restored Wet Meadow areas shall contain a minimum of: 30%cover by native <br /> grass/sedge species,20%cover by native forb species,and 33%of installed <br /> species present. Deep Marsh areas shall contain at least 6 planted species <br /> widely dispersed throughout the planted areas. <br /> 3. If the performance criteria outlined above are not met at any time during the <br /> monitoring period,the permittee shall provide the Corps with a proposal detailing <br /> corrective actions and/or maintenance actions proposed(if any)and an <br /> implementation schedule for those actions. The permittee shall implement the <br /> necessary corrective measures following review and approval/modification of those <br /> measures by the Corps. Upon completion of convective measures,the permittee shall <br /> provide a written summary of the work to the Corps. Additional remedial actions <br /> may be required if the corrective measures do not result in satisfaction of the <br /> performance criteria during the next growing season. <br /> If your project will require off-site fill material that is not obtained from a licensed <br /> commercial facility,you must notify us at least five working days before start of work. A <br /> cultural resources survey may be required if a licensed commercial facility is not used. <br /> This federal authorization is issued under the provisions of Section 404 of the Clean <br /> Water Act(33 U.S.C. 1344). It does not obviate the need to obtain other Federal, state or local <br /> authorizations required by law. The time limit for completing the authorized work ends three <br /> years from the date of this letter. <br /> This letter constitutes an initial proffered permit and contains a signed copy of the <br /> preliminary jurisdictional determination(JD)for your project. Also enclosed is a Notification of <br /> Administrative Appeal Options and Process(NAP)fact sheet and Request for Appeal (RFA) <br /> form which provide information regarding your right to object to these determinations. <br /> If you object to the terms and/or conditions of this initial proffered permit,please see <br /> Section I-A and complete Section 1I of the RFA and submit it to the District Engineer in <br /> accordance with 33 CFR 331. Your objections to the initial proffered permit must be received <br /> by the St.Paul District Office within 60 days of the date of the NAP or you will forfeit your <br /> right to challenge the terms or conditions of the permit. <br /> Before accepting the RFA,the Corps must determine that it is complete,that it meets the <br /> criteria for appeal under 33 CFR 331.5,and that it has been received by the District or Division <br /> Office within 60 days of the date of the NAP. <br />
