• <br />MINUTES OF THE REGULAR ORONO COUNCIL MEETING <br />HELD JULY 26, 1993 <br />( #7) #1834 MARY K. MCCARTY, 245 TONKA AVENUE - <br />VARIANCE - RESOLUTION #3310 <br />Mary McCarty was present. <br />Mabusth explained the applicant seeks a lot area and lot width <br />variance to allow the construction of a new residence on a vacant <br />lot in the Stubbs Bay area which has been provided a sewer stub. <br />She noted Lots 3 and 4 to the north will go tax forfeit and the <br />applicant hopes to acquire the property. The owner to the north of <br />the tax forfeit property has indicated he is not interested in the <br />property, and they are not certain of the intent of the owner to <br />the west. <br />Mayor Callahan asked what happens if the applicant does not acquire <br />the additional property. <br />Mabusth stated then she would be back before the Council requesting <br />setback variances. She indicated the same findings used to justify <br />the sewer stub connection be made to support the current variance • <br />request. <br />It was moved by Mayor Callahan, seconded by Hurr, to adopt <br />Resolution #3310 for Mary McCarty, 245 Tonka Avenue, granting lot <br />area and lot width variances to permit the construction of a new <br />residence on a property that consists of 12,500 s.f. where 87,120 <br />s.f. is required. Ayes 5, nays 0. <br />( * #8) ORDINANCE AMENDMENT - SECTION 12.30 - NON - CONFORMING SYSTEMS <br />REPLACEMENT - ORDINANCE #118, SECOND SERIES <br />It was moved by Jabbour, seconded by Mayor Callahan, to adopt <br />Ordinance #118, Second Series, amending Section 12.30 by revising <br />the required timeframe for repair or replacement of non - conforming <br />septic systems. Ayes 4, nays 0. <br />( * #9) MET COUNCIL - SW AREA MUSA TOUR <br />It was moved by Jabbour, seconded by Mayor Callahan, to accept the <br />information presented regarding the Metropolitan Council's SW area <br />MUSA tour. Ayes 4, nays 0. <br />( #10) NORTH SHORE DRIVE MARINA - 1993 LICENSE <br />Gaffron explained the marina has met all the conditions of the <br />license, but has failed to submit the late fee. They did however <br />overpay according to staff's calculation of 20 allowed boats. • <br />Therefore staff recommends the marina pay the additional late fee <br />of $46.00. <br />N. <br />
