MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON DECEMBER 12, 1994 <br />( #11 - #1984 - Steven M. Englund - Continued) <br />• Mabusth reported the Application is for a renewal variance for lot area. The original <br />variance has expired. The Applicant is presently working on the building plans and is <br />aware of the required setbacks. There are no changes to the Application. <br />Mr. Englund agreed to waive his rights to a public hearing before the Planning <br />Commission. <br />Mayor Callahan opened the public hearing. <br />There were no comments from the public. <br />Mayor Callahan closed the public hearing. <br />Hurr moved, Jabbour seconded, to approve Resolution #3508 for Steven Englund for a <br />renewal variance. Ayes 4, Nays 0. <br />( #12) #1985 BRUCE BREN HOMES, 1000 COX FARM ROAD - CONDITIONAL <br />USE PERMIT - CONTINUATION OF PUBLIC HEARING OF NOVEMBER 21, <br />1994 <br />• Mr. Bren was not present. <br />Jabbour moved, Kelley seconded, to table Application #1985. Ayes 4, Nays 0. <br />n <br />U <br />( #13) B-2 ORDINANCE PROPOSED AMENDMENT <br />Council discussed the proposed amendment to the B -2 Ordinance. Huff asked for <br />clarification of the City Attorney's comments in reference to Subd. 15. The City Attorney <br />indicated he had a concern about the City's authority to regulate the expansion and <br />removal of the number of slips and buoys and lengths of docks. <br />Mayor Callahan indicated it was his understanding that the issue of concurrent <br />jurisdiction is unsettled in the courts. <br />Mayor Callahan indicated he did not believe the City should adopt the LMCD ordinances <br />by reference. <br />The Council directed Staff: to review those sections of the ordinance that refer to the <br />LMCD ordinances. <br />Hurr recommended the amendment be more specific in regard to the enforcement of <br />regulations governing snowmobile sales and service. <br />
