MINUTES OF THE REGULAR ORONO CITY COUNCIL MEETING <br />HELD JANUARY 24, 1994 <br />• (#7) POLICY AND PROCEDURE FOR USE OF DRUG FORFEITURE MONEY <br />(CONTINUED) <br />Jabbour moved, Hun seconded, to approve the proposed policy and procedure regarding the <br />expenditure of drug forfeit money. Ayes 4, Nays 0. <br />( * #8) ANNUAL INVESTMENTS REPORT - INFORMATION ITEM <br />No action required by Council. <br />(#9) AMEND ANNUAL APPOINTMENT TO BUILDING BOARD OF APPEALS - <br />RESOLUTION NO. 3380 <br />Moorse stated that Steve Anderson, Minnetonka Fire Inspector, will be unable to serve on <br />the City's Building Board of Appeals. Staff recommended the appointment of Loren <br />Kohnen, a Contract Building Official for sixteen cities within Hennepin and Wright counties. <br />Hun moved, Goetten seconded, to adopt Resolution No. 3380 appointing Loren Kohnen to <br />the Building Code Board of Appeals. Ayes 4, Nays 0. <br />( #10) DESIGNATION OF RESPONSIBLE LOCAL GOVERNMENT UNIT (LGU) <br />FOR WETLANDS CONSERVATION ACT <br />Goetten stated she was concerned about the expense involved if the City of Orono were to <br />regulate the Wetlands Conservation Act, and inquired what it would cost if the Watershed <br />District were to administer it versus the City becoming the LGU. Gaffron responded that it <br />was his impression from talking to MCWD's Mike Panzer that the Watershed District's <br />application fee covers about an hour of their engineer's time. If more time is required, it is <br />billed back to the applicant. He felt that more time would be used in getting City staff up to <br />speed to administer the program, and thus would increase the City's costs. Goetten inquired <br />if staff felt comfortable having the Watershed District handle this for the present, and <br />Gaffron responded affirmatively, noting if any differences arose, they could be worked out at <br />that time. <br />Hurr stated that she had reservations about handing anything over to the Minnehaha Creek <br />Watershed District as she did not believe they would be as thorough as Orono would be. <br />She felt that staff should administer the Wetlands Conservation Act because they were <br />familiar with the City and this way mitigation measures could be kept under the City's <br />control. Gaffron stated he felt that it was a question of whether the City Council wanted to <br />be in charge of all the Type 1 Wetlands which do not show on the City of Orono's maps. <br />Hurr stated she felt it would be better to keep it within the City's jurisdiction than allow the <br />Watershed District the opportunity to establish wetland mitigation for other cities within <br />Orono. She also indicated it was her understanding that the watershed district had not been <br />• charging application fees, but they should. <br />3 <br />
