ORONO COUNCIL MEETING HELD OCTOBER 22, 1990 <br />NAVARRE HEIGHTS DRAINAGE CONTINUED <br />• Barrett replied, "The statute states that if a petition is <br />below 350, it requires a 4 /5ths vote. There is no other <br />reference. In my preliminary opinion, at this point, since the <br />35% petition has not been officially voted on, it is possible for <br />persons to withdraw their names. If the petition drops below 350 <br />as a result, it will take four Councilmembers voting <br />affirmatively to approve the project. I would like to research <br />that further." <br />Callahan asked at what point in the process the 4 /5ths vote <br />would apply. <br />Barrett replied, "Once the specs have been prepared and bids <br />taken so that a final cost is known, it will be necessary to hold <br />a Public Hearing to order the project. It will be necessary to <br />order the project with a 4 /5ths vote if there is less than 350 on <br />the petition." <br />Goetten stated that she is now concerned about aggravating <br />an existing drainage problem for the residents on Togo Road. She <br />questioned how . this new information will affect this process. <br />Nettles concurred with Goetten. He said, "It appears to me <br />=hat the problem may be more extensive than we first believed. I <br />would like to direct the City Engineer to review th,, Togo Road <br />• area to determine the extent of the drainage problem." <br />It was moved bye Nettles, seconded by Mayor Grabek, to table <br />this item and direct City Staff to review and report on the <br />drainage in the Togo Road area and whether this storm sewer <br />project will have any effect. Motion, Ayes -5, Nays -0. Motion <br />passed. <br />CONSENT AGENDA* <br />It was moved by Mayor Grabek, seconded by Peterson, to <br />approve the Consent Agenda. Motion, Ayes -5; Nays -0. Motion <br />passed. <br />APPROVAL OF MINUTES* <br />It was moved by Mayor Grabek, seconded by Peterson, to adopt <br />the minutes of the Regular Council meeting held October 8, 1990. <br />Motion, Ayes -5, Nays -0. Motion passed. <br />LMCD REPORT <br />LMCD Representative JoEllen Hurr was present. <br />Bernhardson referred Council to the additional information <br />that had been placed before them just prior to this meeting. He <br />stated that he had attended the LMCD meeting on October 16th and <br />had thought that the Board may be willing to explore the proposal <br />from the City of Wayzata.
