ORONO REGULAR COUNCIL FETING HELD OCTOBER 8, 1990 <br />LAFAYETTE RIDGE CONTINUED <br />Bernhardson clarified that as private streets they are • <br />responsible for snow removal, repair maintenance, etc. In a <br />public street, the City would be doing this work except possibly <br />for a major reconstruction. This area would probably not <br />necessitate that for a long time to come as it is up to City <br />standards. <br />Goetten stated this type of situation needs to be studied <br />carefully and approved. There are other streets within Orono <br />that may have similar requests. <br />Nettles asked how long this street was. Since this is just <br />a cul -du -sac it is not significant in cost or City duties. <br />Callahan states the Comprehensive Plan did not take the same <br />view of public streets and PUD's and that may be of significance. <br />He asked if all or some of the private roads are through PUD's. <br />The answer will be found out. <br />The residents asked if they needed to come back for the next <br />meeting if this is not acted on at this meeting. Council noted <br />that they were in attendance and JoEllen Hurr will be their <br />spokesperson at the next meeting. They asked for clarification <br />on why the decision is being postponed. <br />Callahan explained that this issue has come up • <br />occassionally. In this case, the Planned Unit Development had <br />special zoning /building restrictions and part of that is relative <br />to the next part of the problem. The Comprehensive Plan suggests <br />that public streets should serve PUD's and would need further <br />research as to the intent of this section. <br />Mabusth referred to the Parten /Bayside property. As a PRD, <br />you didn't have to exclude the area of the road. If someone went <br />in now and made a public road, then a recalculation of the lot <br />areas would have to be done and this could have an impact where <br />additional area wasn't available and credit was given to units. <br />Council then might be asked to look at some area variance. <br />Comments from residents were added that this is a relatively <br />short street, conforms to City standards and the City <br />maintenance workers go right by on a regular basis. The costs to <br />the City would be minimal. <br />Hurr noted that the Comprehensive Plan talks about the <br />exception being a PUD and this is probably the only PUD Orono has <br />with a private road so that criteria could be used in future <br />requests and may not have to grant to other private roads that <br />may not be PUD's. <br />It was moved by Councilmember Goetten, seconded by Peterson, <br />to conceptually approve the request for a public street in . <br />Lafayette Ridge and to address the concerns expressed before <br />further Council action. Motion, Ayes -4, Nays -0. Motion passed. <br />31 <br />
