Each envelope well exceeds the 1 acre in area. The <br />applicant does not need to apply for the wetland credits under <br />Section 10.55 because he meets the dry buildable area above the <br />932. She noted the B -4 area. This lot will go back to the <br />foundation for a possible future building or may go to the <br />University. <br />Mr. MacKinnon raised the issue of the City upgrading Old <br />Beach Road. The City is asking the developer to share in the <br />cost which is consistent with all previous information. However, <br />in the Memo dated October 5, 1990, Page 5, 3 (D), the applicant <br />is asked to be responsible for the whole upgrading of Old Beach <br />Road. <br />Mabusth stated that this is a conflict in what staff has <br />presented to Landstar. In early reviews, a leveling and 2" <br />bituminous covering of Old Beach Road had been proposed as <br />upgrading by the City. Since that time the City Engineer has <br />recommended a 32' wide curb and gutter typical urban section for <br />this roadway. If this is the case, a share by the applicant may <br />be requested and possible assessing benefiting property owners. <br />This was not discussed by the Planning Commission. <br />City Administrator Bernhardson replied that first the <br />Council has to decide if the subdivision is acceptable and then <br />negotiate the type of upgrading. <br />Goetten added that an informational public hearing would <br />have to be held for those residents already on Old Beach Road. <br />Mabusth asked for input from JoEllen Hurr as to the type of <br />improvements being discussed for the City of Minnetonka Beach. <br />Hurr replied that initially an overlay was discussed. <br />Acting Mayor Callahan reviewed the history of the Old Beach <br />Road area in which this subdivision is proposed. He questioned <br />the building of homes in this swamp area. <br />Nettles replied that he was not comfortable considering this <br />application without knowing what may happen in terms of the road <br />development He states the sewer may be a consideration because <br />of the water quality. <br />Mabusth stated that the developer has always been aware that <br />he will be paying the costs for the extension of sewer and water. <br />John Gerhardson was asked by Mabusth to comment on the kind <br />of road improvement expected in this area. Gerhardson responded <br />by saying that overlay had been planned for this summer but held <br />off to see what would happen with this application.
