7. The Board or Council may permit as a variance the temporary use of a one-family dwelling as a two- <br /> family dwelling. <br /> Response: NA <br /> 8. The special conditions applying to the structure or land in question are peculiar to such property or <br /> immediately adjoining property. <br /> Response: The desire to maintain scale of quaint cottage, built in 1900, site conditions (topography and pond), <br /> and existing easement are the principal factors in seeking the variance and are unique to this property. <br /> 9. The conditions do not apply generally to other land or structures in the district in which said land is <br /> located. <br /> Response: The combination of turn of the century cottage, topography of the site, and travel easement make this <br /> a unique request. <br /> 10. The granting of the application is necessary for the preservation and enjoyment of a substantial <br /> property right of the applicant. <br /> Response: The rebuilding of the dilapidated garage with ample room for two cars, storage, and functional space <br /> above the garage preserve the size and scale of the primary structure (original cottage), while providing much <br /> needed space for modern living. <br /> 11. The granting of the proposed variance will not in any way impair health, safety, comfort, morals, <br /> or in any other respect be contrary to the intent of the Zoning Code. <br /> Response: The dilapidated garage needs to be rebuilt, as it stands it is unsafe. Granting of variance will improve <br /> safety on the property. <br /> 12. The granting of such variance will not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate demonstrable difficulty. <br /> Response: The existing garage is a safety hazard, rebuilding the garage to accommodate much needed storage <br /> and additional facilities is logical in the long-term preservation of the turn of the century lakeside cottage. <br />
