The Planning Commission reviewed this application at a public hearing heid on <br /> March 17, 2014 and voted 6 for and 0 against on a motion to recommend <br /> approval of the variances and CUP to allow the new 2,400 square foot seasonal <br /> cabin to be constructed on the Property and to allow the 700 square foot existing <br /> cabin to remain. The Planning Commission finds that the Tollowing factors <br /> support the granting of the requested variances and CUP: <br /> a. The Property contains 6$,612 square feet in area (1.57 acre) and has a <br /> defined width of 321 feet at the lake and 266-feet at the 75-foot setback. <br /> b. The existing 700 square foot cabin has existed on the Property since the <br /> 1940's. <br /> c. The new 2,400 square foot seasonal cabin will meet all app(icabie setbacks. <br /> d. The Big Isiand Record Lot status granted by Resolution No. 2146 gave an <br /> assurance to owner of this substandard sized property that their property <br /> could be developed without variances for uses considered to be a basic right <br /> of ownership on Big island. <br /> e. Record Lot Resolution No. 2146 was adopted in 1987 and states that the <br /> Property can be used for the following uses subject to strict compliance with <br /> ali building codes, septic treatment codes; and zoning codes: <br /> i. One-family seasonal recreational use without a structure (i.e. dock, <br /> campsite, etc}; or <br /> ii. One new seasonal dwelling may be built; or <br /> iii. An existing seasonal dwelling may be used, improved, expanded or <br /> replaced. <br /> f. The Record Lot status does not itself permit an intensification of uses. <br /> g. The CUP is required in order to permit an accessory cabin over 600 square <br /> feet. <br /> h. The Applicanis have proposed to keep the existing 700 square foot guest <br /> cabin. A lot area variance is required in order to construct the new seasonal <br /> cabin as the Property does not meet the 5.0 acre minimum requirement to <br /> permit an accessory guest cabin. <br /> i. The Appficants are investigating the feasibility of septic system sites to serve <br /> both the existing and proposed cabins on ttie Property. Conformance with the <br /> PaQe 2 of 6 <br />
