Box 66 <br /> Orono, MN 55356 Crystal Bay, MN 55323-0066 <br /> April 20, 2009 <br /> RE: 3240 Sixth Avenue North —Zoning Compliance <br /> The above referenced property is zoned RR-1 B, One Family Rural Residential District, <br /> requiring a minimum lot size of 2.0 acres and 200 feet of width at the right-of-way. The <br /> property has an existing lot area of 1.0 acre and approximately 230 feet of defined width <br /> per Hennepin County tax records. The defined width exceeds the 200 feet minimum. <br /> Principal structure setback requirements are 50 feet from the front and rear property <br /> lines and 30 feet from the side property lines. The existing house appears to meet these <br /> setbacks per aerial photography on file at the City Offices. <br /> If the existing structure were destroyed, a structure could be rebuilt in-kind, same <br /> footprint, volume, roof pitch, etc. If a different structure were constructed it would need <br /> to meet hardcover and setbacks. Variance for lot area would be required in order to <br /> rebuild a different structure on the site. Based on the history of lot area variances for <br /> teardowns/rebuilds it is likely that the City Council would grant a variance, however <br /> hardcover requirements and setbacks must be met. <br /> Also of note, there is a Manage 1 wetland adjacent to the property.
