The City Council finds that granting a conditional use <br /> permit to allow contruction of a detached accessory <br /> structure will not be be detrimental to the health, safety <br /> or general welfare of the public, would not adversely affect <br /> - light, air nor pose a fire hazard or other danger to <br /> neighboring properties , nor will its use depreciate <br /> surrounding property values and that the proposed level of <br /> use of the property wi 11 be in keeping with the intent and <br /> objectives of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono <br /> City Council hereby grants a conditional use permit per Municipal <br /> Zoning Code Section 10.28, Subdivision 3 (A? to permit <br /> construction of a detached accessory structure to be used as both <br /> a garage and storage structure for the exclusive use of Trinity <br /> Lutheran Church located at 2060 Sixth Avenue North, subject to <br /> the following conditions: <br /> 1. A1 1 construction vehicles shall entrance site along the <br /> north side of the church. Applicant must provide protection <br /> of existing drainfield within southwest yard of church <br /> during the construction period. <br /> 2. A1 1 lighting proposed for accessory structure shal 1 not <br /> be used for security purposes and that lighting has been <br /> approved as shown on Exhibit J in the review of this <br /> application as shielding the light rays from adjacent <br /> residential properties. <br /> 3. Authorities granted by this resolution run with the <br /> property not with the applicant, but are permissive only and <br /> must be exercised by the installation of the pond within one <br /> year of the date of Council approval or the special <br /> conditions of this resolution will expire on that date (July <br /> 22, 1992). <br /> 4. Violation of or non-compliance with any of the terms and <br /> conditions of this resolution shall constitute a violation <br /> of the Zoning Code, shall automatically terminate any <br /> authority granted herein, and shal 1 be punishable as a <br /> misdemeanor. � _ , � <br /> Page 2 of 3 <br />
