Municode <br />Page 2 of 5 <br />products and that either have no other meaning or in context are clearly used for their bodily, sexual <br />or excretory meaning. <br />Park means an area reserved, designated or used for active or passive public recreation, <br />except a swimming beach, that is owned, operated or controlled by the city. <br />Sexual conduct means human masturbation, sexual Intercourse, or any touching of the <br />genitals, pubic areas or buttocks of the human male or female, or the breasts of the female, <br />whether alone or between members of the same or opposite sex or between humans and animals <br />in an act of apparent sexual stimulation or gratification. <br />Swimming beach means an area reserved, designated or used for scheduled or open public <br />swimming which is owned, operated or controlled by the city. <br />(Code 1984, § 9.31(2)) <br />Cross reference— Definitions generally, § 1-2. <br />Sec. 22-87. -Application. <br />This article shall apply to all parks and swimming beaches and supplements and is in <br />addition to those provisions of this Code which, by their terms, apply only to specific recreational <br />areas. <br />(Code 1984, § 9.310)) <br />Sec. 22.88. - Exceptions. <br />This article does not apply to city employees or authorized emergency personnel acting <br />within the course and scope of their employment. <br />(Code 1984, § 9.31(3)) <br />Sec. 22-89. - Unlawful acts. <br />It is unlawful for any person to: <br />(1) Enter upon any park between the hours of 10:00 p.m. and 6:00 a.m. of the day next <br />following, when notice is given by signposting. <br />(2) Enter upon any swimming beach between the hours of 6:00 p.m. and 10:00 a.m. of <br />the day next following, when notice is given by signposting. <br />(Code 1984, § 9.31(3)(A), (3)(S)) <br />Sec. 22-80. - Damage to, theft of equipment, objects. <br />No person shall mark, paint, write or post bills upon, deface or In any other way damage, <br />destroy, remove or carry away any equipment; manmade, natural or cultivated plantings, or other <br />thing that is used or situated upon a park or swimming beach. <br />(Code 1984, § 9.31(3)(0)) <br />State law reference— Malicious mischief, Minn.
