If sites <br /> are available within the area of property remaining after the taking,then this property <br /> could continue as a conforming building site. <br /> 1230 Orono Oaks Drive (Developed residential lot) <br /> Legal Description: Lot 5,Block 1, Orono Oaks <br /> - Gross area incl. wetlands: 3.05 acres <br /> -Approximate area in r-o-w: 1.4 acres <br /> -Net area excl. wetlands: 2.85 acres <br /> -Net dry buildable area after taking: 1.65 acres+ (lot area becomes substandard) <br /> -Northerly corner of house will end up 25'+ from rear lot line(50'required). <br /> -Taking will eliminate part or all of existing drainfield(which is nonconforming and <br /> must be replaced by 2010) and previously tested alternate site. <br /> - Existence of additional sites within Lot 5 is questionable due to topography. <br /> It is the City's understanding that MnDOT plans to either combine vacant Lot 4 with Lot 5, <br /> or combine a portion of Lot 4 with Lot 5 and the remainder with Lot 3. We have not been <br /> provided with a survey showing the proposed new lot lines.It is also the City's understanding <br /> that MnDOT is having new septic system sites tested for this property but we have not been <br /> provided with the results. <br /> Lot 5 after the acquisition will be nonconforming as to lot area and the residence on it will <br /> be nonconforming as to location. Assuming that additional dry buildable acreage is added <br /> to result in at least 2.0 dry buildable acres via combination with all or a portion of Lot 4,Lot <br /> 5 would then be considered as conforming in area but still with a house in a nonconforming <br /> location. <br /> 1290 Orono Oaks Drive (Developed residential lot) <br /> Legal Description: Lot 3,Block 1, Orono Oaks <br /> - Gross area incl. wetland: 3.5 acres <br /> -Approximate area in r-o-w: 1.9 acres <br /> -Net area excl.wetland: 2.7 acres <br /> -Net dry area after taking: 1.5 acres (lot area becomes substandard) <br /> -Rear corner of house ends up 20' from rear lot line (50'required). <br /> - Existing and identified future septic sites not affected. <br /> Post-acquisition,this propertywould be considered as anon-conforming developed building <br /> site with a house in a nonconforming location. Lot 3 could potentially be combined with a <br /> portion of vacant Lot 4 to make it conforming in lot area. <br />
