A 35-foot setback is required <br /> from the undeveloped side street or fire lane and the applicant is requesting a variance to permit a 15-foot <br /> setback. Curtis stated the Code is silent on whether or not it is considered a developed or undeveloped <br /> right-of-way. The property directly across from the fire lane is located in the LR-1C district where a 15- <br /> foot setback is required. <br /> Curtis displayed a picture of the fire lane. Curtis indicated there is some vegetation on the east side of the <br /> fire lane. The development of the lot may impact some of that vegetation. <br /> Staff's recommendation is for approval of the setback variance but would like the applicant to provide <br /> some detail about what trees would be impacted by the construction of the home. If trees are impacted, <br /> Staff would like a landscape plan showing how they can provide screening along the property line with <br /> the fire lane. <br /> Berg asked if the other house is 15 feet from the property line. <br /> Curtis stated it is,and while it appears that that house has a greater yard area, it is actually the fire lane. <br /> Landgraver asked if those property owners have been maintaining the fire lane. <br /> Curtis indicated they have been. <br /> Leskinen asked if the fire lane has been abandoned by the City. <br /> Curtis indicated it is not developed and that it has not been open for road use. <br /> Leskinen asked if Staff anticipates any future use of that fire lane by the City. <br /> Curtis stated Staff does not anticipate the fire lane being used by the City and that the applicant is the <br /> property owner on the west side. Curtis stated the intent is not to open it for a roadway. <br /> Schoenzeit asked if the fire lane is posted for public use. <br /> Page 32 of 59 <br />
