Curtis stated if the <br /> work does not require engineering, there is not a regulation that Staff requires it. <br /> Landgraver commented the Planning Commission could still recommend an engineer review the work to <br /> the applicant. <br /> Schoenzeit stated the applicants can choose to ignore the engineering <br /> Thiesse noted there are four tiers shown on Exhibit B and that it appears the walls will be 58 feet in <br /> length. Thiesse stated in his view the walls are ten feet short and that they should go another 27 feet into <br /> the yard in order to make a wall like this work without it being engineered. <br /> Schoenzeit asked if Mr. Briggs is opposed to obtaining engineering for the slope. <br /> Briggs stated he is willing to do whatever it takes to work with the City but that he would prefer not to <br /> incur the additional expense of hiring an engineer. Briggs stated he already has incurred a number of <br /> expenses. <br /> Thiesse asked if the Planning Commission is being asked to approve something that they are not <br /> reviewing tonight or whether the Planning Commission is being asked to provide direction at this time, <br /> with the application coming back before the Planning Commission. <br /> Schoenzeit stated the Planning Commission has seen only one plan, which is not sufficient to accomplish <br /> what needs to be done. <br /> Leskinen asked if this would still need to go through the permitting process of the Minnehaha Creek <br /> Watershed District. <br /> Curtis stated there is some level of permitting with the Watershed District that is required and then the <br /> City will also issue an administrative permit, which is the point at which all the plans are required to be <br /> submitted. <br /> Leskinen asked if what is being requested of the Planning Commission is the conditional use permit to <br /> allow for the grading on the site and not necessarily the permit for the specific solutions. <br /> Curtis stated this is a repair and that the property owners are attempting to put their lakeshore back <br /> together. Curtis indicated the Planning Commission is able to request additional information, but in order <br /> to expedite the matter and have the slope repaired this year, Staff would prefer not to hold the applicants <br /> up another month. <br /> Thiesse indicated he would be in agreement with that. <br /> Lemke noted the slope has been in this condition for the past year. <br /> Schwingler stated the failure is now affecting the adjoining property. <br /> Page 4 of 30 <br />
