If after the commencement of the Work the Archrtect determmes that any of the Work <br /> 1 requires special inspection, testing or approval which Subparagraph 13.5.1 does not <br /> include, the Architect may, upon written authorization from the Owner, in lieu of the <br /> procedure specified in Subparagraph 13.5.1, secure the services of an independent testing <br /> , agency to perform such tests, inspections and approvals. The Contractor, at the <br /> Contractor's expense, shall make a11 arrangemetrts,fumish all samples and materials to be <br /> tested, and deliver the samples and materials to the testing agency. Reports of such tests, <br /> � inspections and approvals shall be submitted to the Architect and the Contractor. The <br /> Contractor or the Owner shall bear the costs of such tests as provided in Subparagraph <br /> 13.53. <br /> � 13.7 COMMENCEMENT OF STATUTORY LIlVIITATION PERIOD <br /> � Delete Subparagraph 13.7.1 and substitute the following: <br /> 13.7.1 As between the parties to this Contract, no action in contract, tort, or otherwise to recover <br /> , damages shall be brought against any party more than three years after the alleged cause of <br /> action has accrued. The cause of action shall accrue on the date of issuance of the Final <br /> Project Certificate for Payment, or on the date of the act or failure to act, or on the date of <br /> ' the discovery by the other party of the act or failure to act, or on the date that the other <br /> party suffers damages,whichever is last. If this Contract is terminated prior to completion <br /> of the Project and there is no date of issuance of the final Project Certificate for Paymern, <br /> ' the cause of action shall be deemed to have accrued on the date of termination of the <br /> Contract, or on the date of the act or failure to act,or on the date of discovery by the other <br /> party of the act or failwe to act, or on the date that the other pariy suffers darnages, <br /> ' whichever is last.
