' <br /> Hennepin County Special Requirements Section 00800 - SUPPLEMENARY CONDITIONS <br /> ' 1/2/02 Edition <br /> Page I 0 of 32 <br /> ' <br /> 8.1 DEFINITIONS <br /> ' Delete the first sentence of Subparagraph 8.1.2 and substitute the following: <br /> , The date of commencement of the Work is the date established in the Notice to Proceed <br /> given by the Owner. <br /> Add the following to Subpara.graph 8.1.2: <br /> ' The Contractor shall not commence the Work nor a11ow any Subcontractor to commence <br /> work until: <br /> , 1. The Contract has been fully executed and the Owner has issued a Notice to Proceed. <br /> 2. The Owner has approved the Contractor's performance and�yment bonds and the <br /> ' bonds have been filed with the Treasurer of Hennepin County. <br /> , 3. The Owner has approved evidence of the Contractor's Liability Insurance, Owner's <br /> Protective Liability Insurance and any other insurance required to be purchased by the <br /> Contractor. <br /> ' 8.3 DELAYS AND EXTENTIONS OF TIME. <br /> ' Add the following to Subparagraph 8.3.1: <br /> The Owner will look first to the Critical Path Method Construction Schedule, if provided by the <br /> ' Contractor, per Paragraph 3.10, for justification of extensions of Contract time. <br /> Add the following Paragraph to Article 8: <br /> ' 8.4 LIQUIDATED DAMAGES <br /> 8.4.1 Time being an essential element of the Contract, and based on the Project Schedule of <br /> ' Substantial Completion within 160 calendar days from the date of Notice to Proceed, it <br /> is hereby agreed that if the Owner determines that an extension is not justified, the Owner <br /> will be entitled to da.mages for failure on the part of the Contractor to complete its <br /> , obligations. In view of the impracticality and extreme difficulty of fixing and ascertaining the <br /> actual damages the Owner would sustain in such event, the Owner shall be entitled to One <br /> Hundred dollars ($100) per calendar day for each and every day beyond the date of <br /> ' Substantial Completion in these specifications. The aforesaid specified amount shall not be <br /> construed as a penalty, but as liquidated damages for any such failure on the part of the <br /> ' Contractor. The act of the Owner in canceling the Contract for any such failure and/or any <br /> unexpected delay shall not forfeit its right to recover liquidated damages from the Contractor <br /> and/or its surety.
