, <br /> Hennepin County Special Requirements Section 00800 - SUPPLEMENARY CONDITIONS <br /> , 1/2/02 Edition <br /> Page 6 of 32 <br /> ' <br /> 5.2 AWARD OF SUBCONTRACTS AND OTHER CONTRACTS FOR PORTION� OF 'I� <br /> ' woRx <br /> Add the following subparagraph: <br /> , 5.2.5 The Contractor agrees to the Owner's right to audit books and records, as stipulated in <br /> Paragraph 2.5 of the Supplementary Conditions to Contract, in reference to the Contractor's <br /> selection,award of Contract and payments to sub-contractors. <br /> ' <br /> Add the following paragraph to Article 5: <br /> ' S.5 PROMPT PAYMENT OF SUBCONTRACTS. <br /> ' S.5.1 Minnesota Statutes, Section 471.425, subd. 4a,requires prompt payment to Subcontractors. <br /> The law requires the prime Contractor to pay any Subcontractor within ten days of the <br /> prime Contractor's receipt of payment from the County for undisputed services provided <br /> ' by the Subcontractor. The law also requires the prime Contractor to pay interest of 1-1/2 <br /> percent per month on any undisputed amount not pa.id on time to the Subcontractor. <br /> ' 6.2 MUTUALRESPONSIBII.ITY <br /> , Change Subparagraph 6.2.5 to read as follows: <br /> 6.2.5 Should the Contractor wrongfully cause damage to the work or property of any separate <br /> contractor, the Contractor sha11, upon due notice, promptly attempt to settle with such <br /> ' other contractor by agreemerrt, or otherwise to resolve the dispute.
