OD?�_��,9 <br /> � - HENNEPIN COUNTY'S APPENDIX S � <br /> SMALL BUSINESS ENTERPRISE PROGRAM <br /> ' Henn in Coun Tar eted Contract Services (TCS) has responsibility for the determination of whether <br /> eP tY S <br /> CONTRACTOR has attained goal or successfully demonstrated good-faith efforts, during the bid/proposal <br /> ' evaluation process and contract performance, to comply with the Small Business Enterprise (SBE) goal <br /> requirements and goals on non-exempt contracts over $100,000. This Appendix S forms a part of all such <br /> contracts. The term "TCS Manager" (Manager) sha11 include the Manager's designates or representatives. The <br /> ' Manager may, as often and at such times as the Manager shall deem desirable, make on=site reviews or <br /> other contacts to ascertain compliance with this policy. <br /> , The SBE utilization goal is up to 20%, based on the opporhmity for contcacting and subcontracting and the <br /> availability of certified SBEs. This 20% SBE utilization goal applies to the original dollar value of this contract. <br /> Hennepin County Targeted Contract Services Srnall Business Enterprise Program's Prime Contractor's <br /> ' Participation Form SBE6 will be used to determine if CONTRACTOR meets this goa1. TCS Form SBE6 must list <br /> all of the subcontractor/supplier(s) to be used on the project, indicate the contract amount for each <br /> subcontractor/supplier, and identify which subcontractor/supplier(s) comprise CONTRACTOR'S SBE utilization. <br /> ' In addition to this, the CONTRACTOR is required to provide a completed Subcontractor's Participation Form <br /> SBE7 from all subcontractors/suppliers noted on the Prime Contractor's Participation Form. TCS Forms SBES and <br /> SBE7 aze a part of this contract as though fully set forth herein. <br /> ' The Manager may grant an exception to the aforesaid goal on a contract-by-contract basis prior to the publication of <br /> the bid specifications or other contract documents, or by addendum. If the exception to the SBE utilization goal is <br /> granted,a Contract Exception Request Form(TC5 Form SBE3) signed by the Manager,will be attached to the end <br /> ' of this Appendix S and the new approved goal shall prevail and wi11 be monitored and evaluated in the same <br /> manner as the original SBE goal. <br /> ' FXCEPTIONS TO SBE GOALS <br /> The CONTRACTOR may request an exception to the aforesaid goal based upon any one of the following <br /> ' situations. To request an exception, the CONTR.ACTOR must submit TCS Contractor Exception Request Form <br /> SBE4 to the Aennepin County Project Manager or county authorized designee for the project/purchase. <br /> � The Manager may grant an exception to the aforesaid goal on a contractar-by-contractor basis for said contract at <br /> any point during the bid/proposaUcontract evaluation process. If the exception to the SBE utilization goal is <br /> granted,a Conhactor Exception Form(TCS Form SBE4), signed by the Manager, and the new approved goal shall <br /> prevail and will be monitored and evaluated in the same manner as the original SBE goal. <br /> , Contracts with Other Jnrisdictions <br /> This exemption applies when another government jurisdiction ar quasi-governmental agency is contracting with the <br /> ' county. <br /> Emergency-Related Purchases <br /> ' This exception applies for emergency or life-safety (threatening) related purchases authorized by the County <br /> Administrator,Deputy Administrator, or the Purchasing Manager. <br /> ' <br /> ' SBE Program Revised by TCS 9/00 <br />
