. � <br /> �O� <br /> O O <br /> C ITY of ORONO <br /> � r A" <br /> ti • <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��9k'Esi;�g'�G NO. 5 7 4 1 <br /> 17 and October 15, 2007 and on a vote of 5 - 1 recommended approval of the <br /> variances, based on the following findings: . <br /> a. Virtually the entire property is within the 0 to 75 foot zone. <br /> b. The addition to the house is necessary to make reasonable use of this <br /> property. <br /> c. The amount of hardcover is not being increased. <br /> d. The property is burdened with an emergency vehicle turnaround for the <br /> private road that serves 2765 and 2771 Shadywood Road as well as the <br /> property. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the Owner and the public, and the effect of the proposed variances on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other p'roperiy in this zoning district; that <br /> granting the variances would not adversely affect tr�c conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but are necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. . <br /> CONCLUSIONS,ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance to Orono <br /> Municip�l Zoning Code Sections 78-1279 and 78-1288 to allow a 19 foot lake setback and <br /> 23.9%hazdcover in the 0 to 75 foot zone subject to the following conditions: <br /> 1. Council approval is based on the site, rain garden and house plans submitted <br /> by the Owners and annota.ted by City sta.ff, attached to this Resolution as <br /> Page 2 of 4 <br />
