C ITY of ORONO <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`�k'EsBo�'`'�G NO. 5 � 4 1 <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1279 AND 78-1288 <br /> FILE NO. 07-3305 <br /> WHEREAS, James E. Zimmerman, a single person (hereinafter "Owner"), <br /> is the owner of the property located at 2745 Shadywood Road within the City of Orono <br /> (hereinafter "City") and legally described as: Tracts C and D, R.L.S. No. 500, Hennepin <br /> County,Minnesota(hereinafter "the Property"); and <br /> WHEREAS, Owner has made application to the City for a variance to <br /> Municipal Zoning Code Section 78-1279 to allow a 19 foot lake setback when a 75 foot <br /> setback is required; and <br /> WHEREAS, Owner has made application to the City for a Variance to <br /> Municipal Zoning Code Sec�ion 78-1288 to allow 23.2 percent hardcover in the 0 to 75 foot <br /> zone when no hardcover is allowed; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held public hearings on August 20, September 17, and October 15, 2007 at <br /> which times all persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#07-3305. <br /> 2. The Property is located in the LR-1B zoning district, where 1.00 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The Property is <br /> approximately 0.71 acres in area and 179 feet in width. It is a peninsula that is <br /> almost entirely within the 0 to 75 foot zone. <br /> 3. The Planning Commission reviewed this application on August 20, September <br /> Page 1 of 4 <br />
