This application was reviewed as Zoning File#10-3469. <br /> 2. T'he Property is located in the B-4 zoning district. <br /> 3. Orono Code Section 78-1578 requires an enclosure for trash conta.iners for <br /> non-residential uses unless the containers are kept inside the principal building. : <br /> 4. The Planning Commission reviewed this application on June 21, 2010 and on <br /> a vote of 5 - 0 recommended approval of the setback variances and conditional <br /> use permit revision, based on the following fmdings: <br /> a. The proposed building will be located 85 feet from Shadywood Road. The <br /> minimum setback for a principal building is 35 feet. It will be screened by <br /> a berm and trees along Shadywood Road and trees along the southeast <br /> property line. Its design is compatible with the principal building. Its <br /> decorative block and stucco walls and standing seam metal roof will help <br /> ensure it remains in good condition. <br /> b. The previously approved location for a trash and recycling enclosure is <br /> between the principal building and the southeast property line. It does not <br /> comply with either the structure to structure setback or the lot line setback. <br /> That location would not accommodate all the trash and recycling <br /> conta.iners the offices and church require. At its proposed location the <br /> accessory building will still be convenient to the service area of the <br /> principal building, facilita.ting trash removal and recycling. <br /> c. A location in compliance with all setback requirements would place the <br /> building near the house on the residential property that adjoins the rear of <br /> the Property. Without restrictions that would be difficult to enforce, the <br /> use and servicing of the trash and recycling conta.iners would disturb the <br /> residents of the adjacent property to the rear. <br /> 5.
