� o� <br /> 0 0 <br /> � CITY of ORONO <br /> � <br /> � :.. � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'ESYi�g'�G NO. � 9 Q tl <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO THE ORONO,MINNESOTA, CITY CODE <br /> SECTIONS 78-736 AND 78-1435 AND <br /> REVISING RESOLUTION NO. 5880 <br /> FILE NO. 10-3469 <br /> WHEREAS, InternaHonal Ministerial Fellowship, a Minnesota non-profit <br /> corporation, (hereinafter "Owner") is the owner of the property located at 2477 Shadywood <br /> Road within the City of Orono (hereinafter "City") and legally described as: Tracts A and B, <br /> Registered Land Survey No. 88, files of the Registrar of Titles, Hennepin County, Minnesota <br /> (hereinafter "the Property"); and <br /> WHEREAS, on July 23, 2001 the City Council of the City of Orono approved <br /> Resolution No. 4674 granting a conditional use permit to allow use of part of the property as a <br /> church, and on November 9, 2009 the City Council approved Resolution No. 5880 revising <br /> the site and building plans approved as part of Resolution No. 4674. <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to the City for a variance to Orono Code Section 78-1435 to allow placement of an <br /> accessory building to house trash and recycling containers closer to the street than the <br /> principal building; and <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to the City for a Variance to Orono Code Section 78-736(e) to allow placement of this <br /> accessory building 7 feet from the southeasterly property line when a 15-foot setback is <br /> required; and <br /> WHEREAS, Frank Masserano III has made application on behalf of the <br /> Owner to amend the site and building plans attached to Resolution No. 5880 to include this <br /> accessory building; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on June 21, 2010 at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 4 <br />
