That deed appears at abstract entry no. 245 and is recorded in <br /> Book 2585 of Deeds, page 532, Document No. 3654129. I assume there will be evidence <br /> at the hearing sufficient to sustain a finding of fact in the Decree of Registration that ihe <br /> grantor in the deed recorded in Book 2585 of Deeds, page 532, Document No. 3654129, <br /> Donald M. Becker, did not intend to exclude any part of the land, but rather to show that it <br /> was subject to the sanitary sewer easement, and that the deed should be consirued <br /> accordingly. I recommend as a defendant Donald M. Becker. <br /> (c) Pursuant to the above mentioned easement the following concluding statement <br /> should be contained in the "subject clause" of the Decree' <br /> To a sanitary sewer easement in favor of the City of Orono <br /> recorded in Book 2585 of Deeds, page 186, Document No. <br /> 3653332. <br /> I recommend the CitV of�rono as a defendant. <br /> (d) The Application at Paragraph "F" indicates that the property is subject to a <br /> purchase agreement dated May 30, 2003 from the applicants to vendee Ellen DeHaven <br /> Peterson. The following concluding statement should be contained in the "subject clause" <br /> of the Decree: <br /> To an unrecorded Purchase Agreement dated May 30, 2003 in <br /> favor of Ellen DeHaven Peterson. <br /> The vendee has consented to the Application and need not be made a defendant. <br /> (e) The Inspection Report discloses that a highway easement encroaches over the <br /> Southerly part of the land being registered. Pursuant to abstract entry no. 170, the <br /> following concluding statement should be contained in the "subject clause" of the Decree: <br /> To Hennepin County State Aid Highway No. 19, Plat 50, Registrar <br /> of Titles Document No. 1484162. <br /> I recommend the Cauntv of Hennepin as a defendant. <br /> 2 <br />
