Finkelstein: <br /> In response to your request for information regarding the <br /> buildability of your separated parcel , I have researched City <br /> files and would make the following comments : <br /> 1. At the request of a previous owner of the property, the <br /> City declared this lot unbuildable in 1974 and refunded the <br /> City water assessment. In 1977, a new owner of the property <br /> applied for a building permit, which ultimately was denied. <br /> No activity has taken place since then other than removal of <br /> the garage which previously existed on the property. <br /> 2. There are a number of additional factors besides the <br /> "non-buildable declaration" which come into play regarding <br /> buildability of this property: <br /> a) To be buildable, the property must contain at least <br /> 0.40 acres of dry land above the 929.4' elevation, and <br /> this acreage cannot include wetlands. <br /> b) No filling can occur below the 931.5' flood plain <br /> elevation for Lake Minnetonka. This property is <br /> adjacent to a wetland that abuts Lake Minnetonka, and <br /> therefore is unquestionably subject to such <br /> regulation. <br /> c) If you were ultimately granted approval to build on <br /> the property, you would have to pay a water connection <br /> charge of approximately $4,500.00.
