Brown arrived at 7:17 P.M. Bellows <br />was absent. The following represented the City staff: <br />Assistant Planning t Zoning Administrator Gaffron, <br />Building Official Jacobs, and City Recorder Peterson. <br />Mayor Grabek and CounciImember Callahan were also <br />present during the meeting. <br />*1218 BSTATB OP KDTB SMITH <br />387 (HKNK> OBCBARD HOAD <br />SDBDXVTSKHI <br />CCMTIHUBD RBPIEII 7:12-7:15 <br />Gaffron reviewed staff's continued recommendation of <br />denial of the two plat application finding the <br />information is incomplete concerning specifically the <br />necessary septic information for Lot 1. <br />Attorney John Krenn, representing the estate, was <br />present for this matter. He referred to a letter from <br />Attorney Larry Berg, who represents Cedric Dettloff in <br />this matter, which acknowledges the responsibility for <br />relocating the on-site septic system on his property if <br />the tests being undertaken should disclose that the on <br />site septic system encroaches upon proposed Lot 2. He <br />noted that they anticipate that the testing will be done <br />prior to the April 25th Council meeting. He stated that <br />the estate is anxious to finalize the purchase agreement <br />for the property and requests Planning Commission make <br />their recommendation at this meeting. <br />Chairman Kelley noted that during the November and March <br />reviews. Planning Commission indicated that they would <br />not recommend approval prior to the necessary septic <br />information, and felt that nothing has changed in this <br />respect. <br />It was moved by Cohen, seconded by Johnson, to recommend <br />denial of the application per staff recommendation. <br />Motion, Ayes 4, Nays 0. (Brown not present for this <br />vote.) <br />*1233 MICHAEL HALLEY HONES INC. <br />2715 PENCE LAND <br />CONDITIONAL USE PERMIT t VARIANCE <br />PINAL REVIEW OP REVISED PLAN <br />Planning Commission held this application until the end <br />of the meeting waiting for the applicant or a <br />representative to be in attendance. <br />It was moved by Chairman Kelley, seconded by Cohen, to <br />table any discussion in this matter until a <br />representative was present. Motion, Ayes 5, Nays 0.
