This alley was <br /> created as part of the plat of Minnetonka Bluffs in 1887, and all streets, avenues and alleys within <br /> the plat were dedicated to the public use forever. <br /> Your property and those to the south of you at 540 and 550 Orono Orchard Road include lots on both <br /> sides of the alley, and in each case the separated lots have been legally combined across the alley. <br /> This does not, however, change the 'public' status of the alley, and both those properties have <br /> historically used the alley for access. The property at 550 Orono Orchard Road constructed a new <br /> detached garage and driveway accessing Orono Orchard in 1989,but still has the right(and perhaps <br /> the occasional need, given the steep slope of the driveway)to gain access via the alley. <br /> The City has no intent to vacate the alley at this time. The City also has no intent to force the <br /> relocation of the Larson's driveway. The relocation you suggested would result in a driveway slope <br /> averaging slightly over 10%, would result in a right-angle turn where it connects to the existing <br /> driveway,and would result in the need for either a 5'retaining wall either side of the new driveway, <br /> or a sideslope cut of as much as 16' either side of the driveway to gain a 3:1 maintainable slope. <br /> These are all negative impacts we would not force upon a property owner. <br /> Your assessment of the lot line rearrangement process is correct. The Larson's would have to be a <br /> willing participant in a lot line rearrangement between your property and theirs. They indicated to <br /> us more than a year ago they have no interest in your proposal.
